Sunshine Analytics, LLC (“Sunshine Analytics,” “we,” “our,” or “us”) is committed to protecting your privacy and providing you a safe online experience. This Privacy Policy applies to Sunshine Analytics, LLC’s World Wide Web site(s) and MaxU platform (collectively referred to as the “Site”) and governs our data collection, usage, and disclosure policies in relation to any services (“Services”) available on or through the Site. References in this Privacy Policy to “you” or “your” means the individual user of our Site.

By using the Site, you hereby acknowledge and agree that: (1) you have read and agree to be bound by the terms and conditions of this Privacy Policy; (2) you are at least eighteen years of age and have the legal capacity to form a contract with us; and (3) to the extent that you are providing your consent for a child under the age of eighteen to use the Services, that you are the parent or legal guardian over that child.

What Information Does Sunshine Analytics Collect from You? 

The information that we collect from you depends upon how you interact with use and our Site, as detailed more fully below:

·     If you choose to register for an account through our Site, Sunshine Analytics will collect personal information, including your first and last name, email address, date of birth, gender, a username, password, and we grant you the option to upload a profile picture (collectively, “ Registration Information”). You may visit the Site without registering for an account.

·     Our Site also enables you to register with us through your Apple, Google, or Facebook account in which case we collect your name, email address, date of birth, gender, and you have the option to use a profile picture (collectively, “ Social Media Registration Information”)

·     If you choose to engage us through the Site for any Services that require making a payment to us, we will direct you to our third party payment card processor who will collect your first and last name, billing address, telephone number, and payment card information (collectively, “ Payment Information”).

·     Our Services include the option for you to take a personality assessment, which will collect answers from you regarding your motivations, interests, emotional feelings, preferences, and perceptions in certain situations (collectively, “ Personality Assessment Information”).

·     If you contact us via email with a question, we will collect your first and last name, email address, and the content of any message that you provide to us (collectively, “ General Inquiry Information”).

·     In connection with your use of the Site, we will collect certain information about you from internet cookies as detailed more fully in the section below titled “Cookies.”

How Does Sunshine Analytics Use the Information that it Collects?

The manner in which we use the information that we collect from you depends upon your interaction with us as detailed more fully in this section.

·     We use your Registration Information or Social Media Registration Information, as applicable to: (i) create your account on the Site with us; (ii) provide you with access to the Site and any Services that you may choose to receive from us; (iii) administer customer, technical, and account support; and (iv) for internal business purposes, including understanding the basic demographics of our registered users, to evaluate our marketing and advertising efforts, and to combat against malicious or fraudulent activity on our Site.

·     Payment Information is used by our third party payment processor to process your payment and to transmit a token to us to confirm your payment for any Services. To the extent that you enroll in Services that require a reoccurring payment, our third party payment processor will process your Payment Information as required to ensure that you continue to receive the applicable Services until canceled. Sunshine Analytics does not directly receive any payment card information.

·     Personality Assessment Information is used by us to provide you with an analysis of your assessment and to provide recommendations based on the results that might be beneficial to you and your aspirations. We also use Personality Assessment Information in an aggregated and de-identified manner to evaluate and improve our personality assessment services.

·     General Inquiry Information is used by Sunshine Analytics for purposes of responding to your particular inquiry of us with the desired information.

·     We use information collected through internet cookies as detailed in the section below titled “Cookies.”

Cookies

Our Site utilizes internet cookies to collect information. “Cookies” are small data files that are deployed by our web server and stored on your computing device’s hard drive. Sunshine Analytics uses cookies to collect information about your internet connection, computing device, and your activity while browsing our Site, including your internet protocol address, the domain of your internet service provider, your computing device type, computing device operating system, internet browser type, originating country, language preference, the web address of the website you just visited, web address of the website that you visit next, access time, and the duration of time that you spend visiting a page on our Site (collectively, “ Usage Information”). Usage Information is used by Sunshine Analytics to (i) allocate web traffic on our Site, (ii) detect, troubleshoot, and resolve issues with our Site, (iii) combat fraud, malicious and criminal activity on our Site, (iv) understand where visitors to our Site originate on an aggregated basis, (v) optimize and improve your viewing experience on our Site by understanding the most commonly utilized computing devices and internet browsers used to access our Site, and (vi) evaluate our marketing and advertising efforts.

You can choose whether to accept cookies from our Site by changing the settings of your internet browser. Does Sunshine Analytics Disclose Information to Third Parties?

In order to provide our Site and Services to you, we utilize certain third party service providers, who render a variety of services to us. These third party service providers render services for us including web and data hosting, software, marketing, Site and application development, payment card processing, accounting, and legal services. We do not permit these third parties to use any information that they receive from us or collect from you for any purpose except for rendering their services to us.

We do not sell, lease, or otherwise disclose the information that we receive from you to any third party. We reserve the right to disclose your information under the following circumstances:

Legal Requirement

We will disclose your information to the extent legally required in response to legal process, including, in response to a subpoena, warrant or other legal process. We reserve the right, in our sole discretion, to assert a legal challenge to any legal demand imposed upon us for information. Notwithstanding legal process, we reserve the right to disclose the information that we maintain about you if we determine that disclosure is required in order for Sunshine Analytics to protect its own rights, property, or the safety of others.

Sale of Business or Business Reorganization

If Sunshine Analytics merges with another organization, reorganizes, or there is a sale involving all or substantially all of Sunshine Analytics’ assets, then the information that we have collected from you will be part of the assets provided to the acquiring entity, unless such a disclosure is prohibited by applicable law.

Children’s Online Privacy

We are sensitive to the privacy of children on the internet and provide additional privacy protections to minor children and the collection of their Personal Information on our Site. For purposes of this section, the term “Personal Information” means first and last name, home or other physical address, email address, telephone number, social security number, and other identifiers as set forth in the U.S. Children’s Online Privacy Protection Act and its regulations.

If our Site involves the collection of Personal Information and is geared at children, we will take the following actions to protect the child’s privacy:

·     We seek information regarding the age of anyone who attempts to register for an account with our Site. If the birthdate of the person reflects they are under the age of eighteen, then we prompt the user with a message that indicates that their parent or, if applicable, legal guardian must first create an account and invite the child to participate. As part of our process for permitting a parent or legal guardian to invite their child to participate with the Services, we require the parent or legal guardian to represent having legal authority over the child and to consent to the types of information that we will collect and the manner in which it will be used, shared, and with whom.

·     We do not send any information to children regarding the products or Services offered by Sunshine Analytics without receiving consent from the child’s parent or, if applicable, the child’s legal guardian.

·     We limit the collection of Personal Information from a child to that information which is absolutely necessary to enable the child to engage in the given Services through the Site.

·     A child’s parent or, if applicable, the child’s legal guardian may request access to the Personal Information that we have collected from their child and request deletion of that Personal Information by following the procedure in this section.

If you suspect that your child has provided Sunshine Analytics with Personal Information without your consent, or if you desire access to or deletion of your child’s Personal Information, please contact us at support@maxu.co and include “Children’s Online Privacy Request” in the subject line of the email. Please clearly describe your request so we may comply with your wishes or where we have questions, follow up with you for more information.

Revisions to this Privacy Policy

Sunshine Analytics reserves the right to revise this Privacy Policy from time to time in our sole discretion. Each time this Privacy Policy is updated, we will update the “Last Modified” date that is listed at the top of this Privacy Policy. Changes to this Privacy Policy will become effective upon their posting. It is your responsibility to regularly check this Privacy Policy to ensure that you remain informed of its contents. Use of the Site or any Services following the posting of a revision to this Privacy Policy will be deemed as your acceptance.

Options Regarding Your Information

If you would like to update or delete any personal information that you have provided to us, including your first and last name, email address, billing address, payment card information, profile picture, or account, you may do so by logging into the Site and making changes to your account profile.

If you do not have an account on our Site, you may contact us via email at support@maxu.co and include the words “Information Request” in the subject line of your message. Please clearly describe your request to us in such a manner that will enable us to carry out your request or to alternatively, contact you, so that we may confirm your instructions. Please note that in accordance with applicable law, we may refuse to honor any information request that we cannot verify or substantiate. If we reject or are unable to fulfill your request, we will provide you with information regarding our decision and our rationale for denying the request.

Hyperlinks to Third Party Websites

The Site contains hyperlinks to third party websites that are not owned, operated, or controlled by Sunshine Analytics (each, a “ Third Party Website”). Any hyperlink to a Third Party Website is provided to you for convenience and for informational purposes only. Your use of any Third Party Website is entirely at your own risk. You hereby expressly acknowledge and agree that Sunshine Analytics has no control over any content, information, business, or privacy practices of any Third Party Website. Under no circumstances will Sunshine Analytics be liable to you or any other party for any loss in connection with your use of a Third Party Website.

We strive to maintain the security over the information that you provide to us. We utilize commercially reasonable technical and organization measures designed to protect the information that we collect from you from a security incident that might jeopardize the security, integrity, confidentiality, or availability of your information.
